Case note on the decision of the Supreme Court in Autoclenz v Belcher Essay

Case note on the decision of the Supreme Court in Autoclenz v Belcher [2011] - Essay Example It sought to establish the actual employment context between the concerned parties as well as the legitimacy of the written term. In this case, the main question to attend to was as to whether the claimants were actually workers, by taking into consideration the already existing regulations such as the 1998 working time regulation (WTR) and the 1999 national minimum wage regulation (NMWR). The decision offered by this court confirms that a lot of consideration should be given to what exactly was the agreement between the concerned parties alongside a written contract terms2. This does not only imply that an employment tribunal (ET) should only consider the terms written at the commencement of the contract, but also at any subsequent phase which might have altered the terms of the contract. Moreover, ET does not need to be confronted by an evidence or intention of third party deceit for it to search beyond an agreement’s written terms. According to the court, the decision does not change in any way employment laws in any way since rationality is allowed in cases that call for it. Background to the case Autoclenz (appellant) is an organization that participates in the provision of car-cleaning services to both auctioneers and motor retailers. On the other hand, the claimants (respondents) consist of 20 valeter individuals who offered their services to Autoclenz as car valeters. All these valeters signed a contract at the begging with Autoclenz which stated that they were self-employed hence their taxation will be based on that3. However, later in 2007, the claimants were subjected to new contracts by Autoclenz which they were required to sign. The new contract had two main clauses: The first clause allowed the valeters to engage another individual to perform services on their behalf as long as that individual met Autoclenz employment standards. Secondly, by handing over responsibilities to another person, that particular individual’s services will n o longer be needed by Autoclenz. There was also a clause that accorded the veleters a right to work refusal. Moreover, the veleters were to give their absence notification in advance4. The claimants later placed a case at the employment tribunal seeking to be recognized as workers considering the definition of a worker by the WTR and MNWR. Basing on these two employment regulations, they also claimed that their remuneration should be in harmony with the NMWR. On the contrary, these claims seemed to be inconsistent with what the written terms of the contract depicted5. Autoclenz considered the valeters to be self-employed individuals who were not in a position to claim the statutory benefits of an actual employee. The two mentioned regulations look at worker from an identical ground as a person who works under: An employment contract. Or other contracts (implied or express). At first the ET held a stand that the veleters can be taken to be workers as well as employees, since Autoclen z exercised much control over them and they were completely in the business6. Furthermore, all the veleters seemed to have no idea of the substitution clause and for the fact that no one of them had participated in it. However, later the EAT giving the saga a different approach argued that since no clauses whether those of substitution or obligation can be inconsistent with employment contracts or personal performance contracts according to the law, then using the written agreement, the valeters were workers but not employees7. Finally, the Court of Appeal settled on the ET’s decision that considered the valeters as being both workers and employees. Main issue and judgment The main issue in this case was for the Supreme Court to establish whether there is a dispute over what is

Hard Rock Cafe Term Paper Example | Topics and Well Written Essays - 1250 words

Hard Rock Cafe - Term Paper Example Forecasting is one method that has led to the success of the restaurant. With forecasting, the management can analyze the forces of demand and supply and make reasonable decisions. They can also determine the point where profits will be maximized. However, forecasting is not realistic as it can be affected by economic changes due to the cyclical nature of the market (Evans 2002). The actual results might differ from the forecasted data giving rise to risk. Therefore, it important to ensure that proper forecasting is done using reliable data and models. Introduction Hard Rock Cafe has grown at a very fast rate from a one pub in 1979 to cafe having 129 branches in over 40 countries internationally. With such growth, the Cafe has been successful in delivering quality services and ensuring maximum customer satisfaction. Nowadays, the hospitality industry is growing drastically. For this reason, the hotels require consistent progress to attain a competitive edge. Operations management is important to ensure that daily activities of an organization are achieved efficiently. This report will analyze the operation management of Hard Rock Cafe with regard to its forecasting strategy. The current forecasting strategy of the Restaurant will be analyzed and suggestions on other possible strategies with regard to sales will be discussed. In order to assess the future perspectives, it is important to analyze the current situation first. 1. Hard Rock Cafe’s forecasting strategy There are different forecasting applications at Hard Rock Cafe. The forecasts relate to the long-run, intermediate and short run. Long run forecasting methods are used in establishing a better capacity plan. Intermediate forecasting methods are used when Hard Rock Cafe aims at establishing good contracts with its main suppliers. The method is used to forecast on revenues using the pricing and costing information in respect of every cafe. Short term forecasting is used on daily sales and takes in to account variables such as events. The point of sale (POS) system is used in forecasting sales. The POS captures daily sales for each customer in all its cafes around the world. All daily sales are transmitted to the headquarters database electronically. From there, the financial team uses the data for forecasting purpose. In forecasting any anticipated events that might impact sales forecasts are taken into account. Such events might include sporting events or concerts to be performed anywhere near the cafes. The daily forecasts are further broken down to hourly sales which are used for employee scheduling purposes. Another forecasting strategy is Cafe’s menu planning which is done using multiple regressions. Multiple regression analysis helps the managers determine the degree of responsiveness on the quantity demanded to changes in price. Forecasting is also used in reorganizing the menu. This is because it measures the domino effect it would have on the menu items. Forec asting is also used in evaluating the performance of managers and setting rewards such as bonuses. Hard Rock Cafe uses a 3 year weighted moving average on cafe sales for this purpose. Bonuses are awarded when managers exceed their targets. Finally, forecasting is used in staff recruitment and management. Future demand is calculated and used to determine the period when to hire more staff or manage its staff in each department of the restaurant. Hard Rock Cafe can also use forecasting in the following areas: Establishing new outlets Determining future market changes by analysis the economic factors New products and its impact to the customers. 2. My Writing Experience and Thoughts about Different Cultures Essay Example for Free

My Writing Experience and Thoughts about Different Cultures Essay First of all, I would like to talk about my writing experience. In China, primary students originally talk about the pictures in primary school. There is no particularly difficult impression in my memory, But when I was in high school, I found a primary school second grade examination paper and I found articles particularly well written. I am surprised, I get so good at writing, but also particularly well written. After, grade level increases, When I was in 5 Grade, the teacher asked me to keep a diary every day, but my mind is empty and I do not know what to write. So I just wrote the diary about what happened each day. I was afraid of my teacher said that I cant write very well. Later, when I was in junior high school, I still dont know how to write and what should I write. I remember an unforgettable experience, it is a composition lessons. At that time, my Chinese language teacher ask me to write about the composition of spring as homework, I remembered that I have a book seems to be an article which was written about the spring in my drawer. Thats my cousins textbook when he was in high school, I usually read it if I have a spare time. Thus I opened the catalog and found this article, then I excerpt some well written sentences to complete the composition. When I watch the article I accomplished, I wondered how beautiful sentences which I copied form the first paragraph, and it is also especially good at the last. I was so frightened, because I know that if I hand it to my teacher. Not only the teacher didnt believe I wrote, even I dont believe it. I should say I was lucky. She was not aware of this problem, but I felt so guilty. Later, I found that the au thor which I copied the original article from is a very famous writer in early China. I think my behavior is disrespectful to him. Since then, I had no interest in plagiarism and I began to write article all by myself. I no longer have a copy of the composition, instead of learning their thoughts. Since that time, I concluded a truth, although the plagiarism is a bad behavior, it is also in the process of looking for good ideas. After that I read a lot of books and learned to analysis and appreciation. It laid the foundation for my future writing, this is a big harvest to me. In the United States, plagiarism is a very serious behavior of cheating, but this is very different to China, In China, language teachers always promote students to learn from those who write a good article, even require students to recite those articles and then students can modify this article into their own article. This is a necessary process in China, a lot of good articles learned in class, the teacher will ask students to recite these articles . For me, writing in English is very different from writing in Chinese, although as a Chinese student I started to learn English when I was very young, and did a lot of English writing since primary school, but English is not my original language. Besides, the English wring practice in China is very limited. Specifically in the model of thinking, Chinese and English are in widely vary. Many times, the sequence of grammar between Chinese and English is the on the opposite, so when we write in English, many sentences are called Chinglish. It is probably that maybe many Chinese people can understand the meaning but the Americans do not necessarily know the meaning of it. So, English Writing is such a challenge for me, here is the U.S., I wrote the article is not for the Chinese people, it is written for people here to read, I must think the ways in Americanï ¼Å'to let people here know what I say. So the most important thing I have to do is that I must adapt to American life , and learn the way of thinking in American so quickly, then use the thinking of U.S. to writing. Only in this way, I can adapt to life better and complete my studies here . I chose the major of Business Management, so there may be a lot of writing about Business Management in my further study. So I must learn the writing skills and method well in this writing lesson, and then do a better writing in further courses of study. The differences of cultural may cause differences in students ability, which is reflected in the students between United States and China very clearly. In China all of the knowledge are imparted to students by teachers, Chinese students only need to remember the knowledge that their teacher told them. If you remember it exhaustiveï ¼Å'you can get a good grades in this course. In the United States , the teachers always train students to focus on the ability which they interested in, regardless of the students ideas are correct or not, as long as he has his personal reasons, it will be a good answer. In my opinion, Chinese students have a strong ability to remember so many things though, but they serious lack the ability to think things independently and they lack the imagination. In the classï ¼Å'they are not good at expressing their ideas, because they always looking for the right answer, which could be widely recognized . There are also some differences in writing. In China, junior high school students have a same writing style, The teacher teach them to write with same skills and the contents of the article are almost same at all. Although I do not know the style of American students writing, but in my guess, their writing must have their own ideas. In my opinion, whether writing in Chinese or English , we must have our own ideas, Only in this way, articles will be more valuable.

Australian Climate Essay -- Weather Environment Australia Essays Paper

Australian Climate Australian Climate Zones When looking at the climate of Australia, we can break up the continent into three basic areas of climate. The tropical region containing the northern peninsulas of Australia, as well as the city of Darwin, is hot and extremely wet. Average maximum temperatures range from 30 - 39 °C with an average annual rainfall of up to 400 cm. The tropical north is covered with rainforests and is regularly hit by tropical monsoons, hence the extreme amount of precipitation. Secondly, the central deserts and grasslands cover over seventy percent of the inland and receive the least amount of rain, from 12 to 100 cm annually. The maximum temperature ranges from 24 °C in the southern deserts to over 36 °C in the northern grasslands. This enormous section of Australia is usually referred to as the â€Å"Outback† and is not densely populated. The third and most heavily-populated climate area is the temperate south and southeast. The big cities in Australia – Melbourne, Sydney, Canbe rra, Brisbane and Perth – are all located in the south, and all in the southeast except for Perth. We will focus on the southeastern coastal area when talking about this temperate climate zone, as the vast majority of Australians live in this area. The climate here is very moist and mild; although not as wet as the tropical north, receiving anywhere from 50 to 320 cm of rain annually, but much wetter in comparison to the Outback. The average maximum temperature in the southeast ranges from 12 to 27 °C, which is more livable compared to the rest of the continent. To understand just how these climate zones function, we must look at the subtropical high that exists in the southern â€Å"horse latitudes† of around 30 °S. The Subtropica... ...on of El Nino, which many think has to do with increased pollution and other human influences on the environment, has created an almost constant state of drought in Australia. For the citizens of Australia, we can only hope that the global community can strive to treat the environment better, as the smallest detrimental actions can have far-reaching consequences when it comes to weather and society. The Impact Of Wwi For Artists Paul Nash And Marcel Duchamp...

Research Essay Impact of †¨WWI for artists-Paul Nash and Marcel Duchamp As a number of leading artists got involved in the War, most of the art campaigns stopped. Individual artistic creations became less radical and started to step down from abstraction to concrete representations. In particular, the program in which the government appointed the artists as war correspondents has resulted in some of the most exceptional artworks of this century. This is, perhaps, because the artists have been exposed to wider issues of human nature, which were absolutely catastrophic and tragic. †¨ †¨ As an official war artist who was sent to the Western Front in 1917, Paul Nash was turned from a traditional landscape painter to one with strong anti-war sentiments after experiencing its devastating effects. During the War, his paintings reveal the scenes of total desolation. For example, his painting entitled We are Making a New World, displays a malleable landscape constantly reshaped and redrawn by bombardment and attacks in a heavily ironic way with the sun still arises – The splendid sunrise over the mountains and the landscape only contrasts the fact that the once dense woodland has been deprived of its glory because of the gunfire. This is what the war has created! The ironic title for this barren landscape just reminds people who were part of the War of what they were actually achieving. †¨ †¨ The connection between the WWI and art history can be possibly dated back to
